SYNOPSIS
Of the Regular Meeting of the Charter Township of Oxford Board of Trustees held on February 11th, 2004 at the Oxford Veterans Memorial Civic Center.
PRESENT: Trustee Clancy, Supervisor Dunn, Trustee Dywasuk, Treasurer Ferrari, Trustee Kniffen, Clerk Sanderson
ABSENT: Trustee Fitchena
The following actions were taken:
Approved the agenda as amended. Approved the following minutes: Regular Meeting held January 28, 2004 as presented. Approved the bills through February 5, 2004 as presented and authorized Clerk Sanderson to issue warrants and distribute funds accordingly.
Opened Public Hearing to consider proposed text amendments to Oxford Township Zoning Ordinance No. 67: ZO-04-01 – To provide for the merger of non-conforming lots, to amend Artticle 22, Section 2211 (B)(2), General Provisions. Nonconforming lots, nonconforming uses of land, nonconforming structures and nonconforming uses of structures and premises.
Nonconforming Lots.
Closed the Public Hearing.
Sent proposed text amendments back to the Planning Commission, as suggested by the Township Attorney, with the following changes:
Article 1.2b.:
“……granting of variances except that the Zoning Board of Appeals shall also consider whether the operation of Subsection a. or an agreement of identical effect is reasonable in light of the nature of the lots in the vicinity of the lots(s) at issue as divided will be adequately serviced by sewer and/or eligibly for septic tank use, and shall not deny an …?
Article 4, line 8:
“….the Township outside the limits of cities and villages that is not less than 10% 15% of the total vote cast . . .?
Approved the Second Reading and adopted proposed Ordinance No. 117 – Safety Path Regulation Ordinance as presented.
Appointed Thomas Berger to the Planning Commission, replacing Dan Clark, for a three-year term commencing from the date of appointment to December 31, 2006.
Appointed James P. Butler to the Zoning Board of Appeals, replacing Brian Glowiak, fox a three-year term commencing from the date of appointment to December 31, 2006.
Directed Supervisor Dunn to write a letter to Dan Clark thanking him for his years of Planning Commission service.
Adopted the Resolution to be included inn, the 2004 Gypsy Moth Joint Operating Agreement and authorized signatures of the Supervisor and Clerk.
Approved the final invoice from Etkin Skanska in the amount of $33,348.00 with the understanding that Oxford Township is to receive the Unconditional Waiver of Liens.
Approved Oxford Township contributing 5% of paving costs for Estate Drive, Country View Drive and Broad Meadow Drive – Country View Estates No. 1 Subdivision, contingent upon receipt of a valid petition.
Set February 25, 2004 for the First Reading of Amendment to Ordinance No. 43A (re: Contributing to the Delinquency of a Minor.
Affirmed that the Charter Township of Oxford Board of Trustees is committed to looking for a new facility to house the Township Hall.
Directed the Building and Site Committee to investigate the cost of constructing a new Township Hall and also explore buildings available for rent or purchase to accomplish the same goal and report back within three months.
Approved to pay back the Building and Site Fund money that went to the Water Fund as soon as possible.

PUBLIC HEARING
CHARTER TOWNSHIP OF OXFORD PLANNING COMMISSION
PROPOSED ZONING ORDINANCE TEXT AMENDMENT
Notice is hereby given that the Charter Township of Oxford Planning Commission will hold a Public Hearing on Thursday, June 12, 2003, beginning at 7:30 p.m., or as soon thereafter as may be heard, at the Oxford Veterans Memorial Civic Center, Second Floor., 28 North Washington, Oxford, MI 48371.
The purpose of the hearing is to receive public comments on a Proposed Amendment to Ordinance No. 67, Article 22, Section 2216. F.- GENERAL PROVISIONS, PERFORMANCE STANDARDS, Noise.
A copy of the complete text is available for the public at the Oxford Township Offices, 18 West Burdick, Oxford, MI 48371, during regular business hours, Monday through Friday (except holidays), 8:00 a.m. to 5:00 p.m.
The Charter Township of Oxford will provide necessary reasonable auxiliary aids and services, such as signers for the hearing impaired and audiotapes of printed materials being considered at the meeting/hearing. Individuals with disabilities requiring auxiliary aids or services shall contact the Charter Township of Oxford, by writing or calling, Clara J. PRESENT: Trustee Behnke, Supervisor Dunn, Treasurer Ferrari, Trustee Kniffen, Clerk Sanderson
ABSENT: Trustee Bellairs, Trustee Fitchena
The following actions were taken:
Approved the agenda as presented.
Approved meeting in Open Session to entertain a motion and take a roll call vote regarding calling a Closed Session for the purpose of discussing pending litigation in the matter of Charter Township of Oxford v Village of Oxford, and a written opinion letter prepared by the Township Attorney concerning this case and discussing pending litigation of Charter Township of Oxford, et al. v Constable, et al., and a written opinion letter prepared by the Township Attorney concerning this case with attendance to include Attorneys Morrison and Kaye and Recording Secretary Exel.
Closed the Closed Session.
