Public Notice: Township Zoning Ordinance No. 50 amendment, first reading approval

NOTICE IS HEREBY GIVEN that at its regular meeting on April 5, 2022, at the Township Hall located at 6483 Waldon Center Drive, Clarkston, Michigan 48346 Township, Michigan, the Charter Township of Independence Board of Trustees approved the First Reading of Amendments to the Township Zoning Ordinance (Ord. No. 50).
It is the purpose of this Ordinance to regulate signs within the Township, pursuant to the Township’s police power in order to protect the health, safety, and general welfare of the citizens of the Township. Second reading is set for April 19, 2022.
A true copy of the Ordinance is on file and available for viewing between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday at the Independence Township’s Clerk’s Office, 6483 Waldon Center Drive, Clarkston, Michigan 48346 Michigan.

ORDINANCE AMENDING ZONING ORDINANCE
(Text Amendments to
Zoning Ordinance)
AN ORDINANCE TO AMEND THE INDEPENDENCE CHARTER TOWNSHIP CODE OF ORDINANCES, CHAPTER 50, “ZONING ORDINANCE,” BY AMENDING ARTICLE 12, “SIGNS,” SECTION 12.07, “PERMITTED TEMPORARY SIGNS” FOR PURPOSES OF INCREASING THE TIME PERIOD FOR WHICH TEMPORARY SIGNS MAY BE INCREASED TO 64 SQUARE FEET IN ALL DISTRICTS PRIOR TO A LOCAL, STATE, OR NATIONAL ELECTION.
Section 1 of Ordinance
“Section 12.07, “Permitted Temporary
Article 12, “Signs,” Section 12.07, “Permitted Temporary Signs,” Subsection D(3) “Standards for All Temporary Signs” of the Charter Township of Independence Code of Ordinances shall read as follows:
D. Standards for All Temporary Signs.
3. In recognition that there is a need for additional expression of speech prior to a scheduled election, the following applies to temporary signs within the Township for a period of up to forty-five (45) days prior to and three (3) days following a local, state, or national election on which there is at least one ballot item. The maximum allowable area of temporary signs shall be increased to sixty-four (64) square feet per premise in all districts. The maximum area of an individual sign remains as stated in the table above during this period.
Section 2. REPEALER.
All ordinances, parts of ordinances, or sections of the Charter Township of Independence Code of Ordinances in conflict with this Ordinance are repealed only to the extent necessary to give this Ordinance full force and effect.
Section 3. SEVERABILITY.
If any section, clause, or provision of this Ordinance shall be declared to be unconstitutional, void, illegal or ineffective by any Court of competent jurisdiction, such section, clause, or provision declared to be unconstitutional, void, or illegal shall thereby cease to be a part of this Ordinance, but the remainder of this Ordinance shall stand and be in full force and effect.
Section 4. SAVINGS.
All proceedings pending and all rights and liabilities existing, acquired, or incurred at the time this Ordinance takes effect, are saved, and may be consummated according to the law in force when they were commenced.
Section 5. EFFECTIVE DATE.
This Ordinance shall be effective following a second reading upon publication in the manner prescribed by law.
