Sidewalk repairs

Sidewalk repair work continues this week, with contractors replacing sections of broken or heaved sidewalk sections throughout the city.
The criteria used for determining which sections to replace was based on trip hazards – sections heaved by half an inch or more were replaced while sections heaved by less than half an inch will be ground flush later in the summer, said City Manager Jonathan Smith.
Funding comes from the city budget and Parking Kiosk revenue, Smith said.

    I am a frequent walker in the city, and I’m getting older every day, so I am very pleased that repairs are being made but why only some and by what priority? Are we supposed to be pleased that anything is done at all, even if done incorrectly? Why does our city administration and elected council continue to ignore the very laws they approved along with state and federal requirements?
    Why is it that the city is only replacing and repairing sidewalks “based on trip hazards” as noted in this article instead of city ordinance (section 93.03), State, and Federal ADA requirements?
    Last week the Clarkston News reported that the sidewalk on East Church, which has excessive cross slope, is not being repaired due to the engineering assessment not being done. Why hasn’t it been done? The city has known about this for years and it is a location used by many to go to school, church and the summer Farmers’ Market.
    Several sidewalks are being replaced at curb cuts and crosswalks without the ADA required detectable warnings. Other similar areas are not being done at all even though required by all governing laws.
    Mill Street at Main between Rudy’s and The Fed is in poor condition, has excessive cross slope, is a tripping hazard, and at a handicap parking spot but no indication it is being fixed even though it is probably one of the most walked areas in the city.
    The pavers used at driveways in the downtown area are all spalling, many have excessive cross slope, but no known plan to do anything about it.
    Sidewalks easily have a life of 20 years or more so if done wrong now, we will all have to live with it for many, many years, or spend even more of our limited funds to do it all again because no one bothered to ask questions, prioritize the work, and make sure it is done correctly.

    City of the Village of Clarkston ordinance section 93.04:
    Any new repair, replacement or construction of sidewalks shall be in accordance with American Association of State Highway and Traffic Officials (AASHTO), Guide for the Planning, Design and Operation of Pedestrian Facilities and American with Disabilities Act (ADA) requirements with the following minimum requirements:
    (A) Sidewalks shall typically be constructed of four-inch thick concrete with six-inch thickness at driveways. All concrete shall be placed on a minimum two-inch compacted MDOT 22A aggregate fill;
    (B) Sidewalks shall slope no more than one in 20 (5%) along the path of travel and no more than one-fourth inch per foot (2%) perpendicular to the path of travel; and
    (C) All curb cuts shall have slopes, surface treatment and construction in accordance with ADA requirements.
