The Village of Lake Orion has sent a notice of default to developers of the Atwater Commons, hoping to get up to eight identified issues resolved.
The Planned Unit Development agreement (PUD) between Aspen Group/Atwater, L.L.C., Gulf Atwater, L.L.C. and the village was recorded at the county in May of 2003. S.R. Jacobsen Companies and the Atwater Commons Condominium Association were also copied on the default notice.
The PUD agreement included a phasing plan, but village officials said improvements required to complete the project are long past their due date.
Council instructed Village Manager Paul Zelenak to look into the matter earlier this year, and at recent meetings Zelenak provided updates, including some frustration in getting ahold of the responsible parties.
Incomplete paving and landscaping, a missing light pole, damaged curbing and a potentially abandoned sales trailer were among concerns listed by the village.
The notice of default requires that improvements must be completed to the satisfaction of the village by Oct. 7. If not, the village will proceed with a hearing and could choose to complete the improvements using the proceeds of existing letters of credit.
One of the identified deficiencies, the last two buildings in Phase II, is not expected to be completed by the deadline. The village is instead asking for an amended timetable for completion.
