Action last week by the Orion Township Board of Trustees could put an end to the ongoing marina issue on Pine Island.
But Township Supervisor Jerry Dywasuk, was not so optomistic when he saw the marina item on the Dec. 18 agenda.
‘I was concerned that this was brought back to the board in the first place,? he said.
The action taken by the board offers former state senator Mat Dunaskiss satisfactory resolution of the current litigation (ie. withdrawal of claims by both sides without prejudice and mutual dismissal of the matter) if Dunaskiss agrees to pay attorney and court costs.
However, if Dunaskiss fails to meet pro-actively with the township on the matter or initiates use of the marina in 2007, the township is able to take action again.
‘We’ve been in court on this and have basically gotten no response from Mr. Dunaskiss,? said Dywasuk, who voted against the measure, along with Clerk Jill Bastian.
All four trustees voted for the motion, saying they have faith that Dunaskiss will cease his operation in light of recent events.
Dunaskiss withdrew his proposal with the MDEQ a few months ago.
Right before that, the township decided to take the issue to court, a move that Dywasuk said prevented the MDEQ from granting Dunaskiss? proposal.
Dywasuk also noted that the former state senator brought a countersuit against the township that was quickly dropped.
Dywasuk added that the board took its action last week to prevent more court costs.
‘If he has boats at his marina again, we’ll have to start all over again,? Dywasuk said, saying he doesn’t think the issue is fully resolved yet.
‘I hope I’m wrong,? he added.
