You’d have to go through tons of meeting notes to find the last time a village or township Construction Board of Appeals met in Orion.
What’s believed to be the first such meeting of that board in about 20 years will take place next week in the Village of Lake Orion, and it centers around the Orion Pointe Development on Pelton’s Point.
An attorney representing two Broadway residents near that site filed the paperwork for the appeal, which will be heard next Wednesday (June 11) at 7 p.m.
‘The appeal has to do with easement interest that (residents) have in relation to the Orion Pointe Development,? said Village Manager Paul Zelenak.
An existing PUD agreement between Orion Pointe and the village includes expanding the easement from 10? to 22? to allow for two-way traffic.
Zelenak said the appealing residents are concerned that this will greatly expand the use of the present easement and will have substantial adverse affects on their property.
The village uses the same Construction Board of Appeals as the township, and reappointed those members (Mike L. McReynolds, Richard Hamilton, Steven J. Auger, Phillip D. Gentile and Robert Smith) at their regular meeting last week. The terms expire next May.
The council also agreed to pay those members $50 per meeting.
Township Building Official Tom Berger also serves in that capacity with the village, and Zelenak said Berger has followed the State Construction Code in examining the easement issue in this case.
