Nearly six months after being arrested for drunk driving, RCOC Board Chairman Rudy Lozano was sentenced in 52-2 District Court on March 27 for driving while impaired.
Appearing before Judge Kelley Kostin, Lozano received 12 months reporting probation, 40 hours community service for a nonprofit organization, refrain from using alcohol, and pay fines and costs totaling approximately $705. In addition he must attend a victim’s impact panel, weekend alcohol class and be subject random alcohol tests at his expense.
Lozano’s attorney Mark Lyon also confirmed that Lozano’s driving license has been restricted since March 1 for 90 days.
‘I think it was fair,? said Lozano. ‘I didn’t see anything outlandish. The (sentencing) guidelines are pretty standard.?
‘We’re satisfied,? said Assistant Lapeer Prosecutor Matt Funke, who felt the punishment fit the crime.
During the sentencing, Judge Kelley Kostin addressed Lozano saying the fact that he was a public figure needed to be acknowledged and hoped he could learn from the incident.
The sentencing was scheduled for March 8, but was adjourned to March 27 after prosecutors asked that Lozano complete a presentencing alcohol investigation.
Lozano plead to the lesser charge of driving while impaired on Feb. 10 after originally being arraigned on Nov. 9. The charge for operating his vehicle while intoxicated stemmed from his Oct. 7 arrest near his home in Independence Township by the Oakland County Sheriff’s Department.
