NOTICE IS HEREBY GIVEN that at its regular meeting on June 4, 2019, at the Township Hall located at 6483 Waldon Center Drive, Independence, MI  48346, the Charter Township of Independence Board of Trustees approved the Introduction and First Reading of an Ordinance amendment adding a New Appendix C – Franchises and scheduled a Second Reading of the amendment at a regular meeting to be held on June 18, 2019 to consider adoption of the ordinance as follows:

APPENDIX C – FRANCHISES

AN ORDINANCE to amend THE INDEPENDENCE CHARTER TOWNSHIP CODE OF ORDINANCES TO ADD A NEW APPENDIX C, FRANCHISES, TO IDENTIFY AND LIST APPROVED FRANCHISES IN THE TOWNSHIP AND CREATE NEW ARTICLES I THROUGH III IDENTIFYING APPROVED FRANCHISE AGREEMENTS FOR CONSUMERS ENERGY GAS COMPANY, COMCAST, AND MICHIGAN BELL TELEPHONE COMPANY, D/B/A AT&T.

THE CHARTER TOWNSHIP OF INDEPENDENCE ORDAINS:

Section 1. ORDINANCE AMENDMENT.

The Independence Charter Township Code is hereby amended to add Appendix C, “Franchises,” to read as follows:

ARTICLE ll. – UNIFORM VIDEO SERVICE LOCAL FRANCHISE AGREEMENT WITH COMCAST OF COLORADO / FLORIDA / MICHIGAN / NEW MEXICO /

     PENNSYLVANIA / WASHINGTON (COMCAST): Agreement on file in the Township Clerk’s Office

     ADOPTION DATE: May 16, 2017; Motion #2017-05-093

     TERM: 10 Years

Section 4. ORDINANCE AMENDMENT.

ARTICLE lll. – UNIFORM VIDEO SERVICE LOCAL FRANCHISE AGREEMENT WITH MICHIGAN BELL TELEPHONE COMPANY, D/B/A AT&T; Agreement on file in the Township Clerk’s Office

     ADOPTION DATE: October 18, 2016; Motion #2016-10-175

     TERM: 10 Years

Section 5. SEVERABILITY.  If any subsection, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent portion of this ordinance and such holding shall not affect the validity of the remaining portions of this ordinance.

Section 6. SAVINGS.  All proceedings pending and all rights and liabilities existing, acquired or incurred at the time this Ordinance takes effect are saved and may be consummated according to the law in force when they were commenced.

Section 7. REPEALER.  All ordinances or parts of ordinances or Sections in the Charter Township of Independence Code of Ordinances in conflict with this Ordinance are repealed only to the extent necessary to give this Ordinance full force and effect.

Section 8. EFFECTIVE DATE.  This Ordinance shall be effective upon publication in the manner prescribed by law.

Section 9. ENACTMENT.  This Ordinance is declared to have been enacted by the Township Board of Trustees of the Charter Township of Independence at a meeting called and held on the ________ day of ________, 2019, and ordered to be given publication in the manner prescribed by law
