The hearing on the judicial misconduct charges against 52nd District Court Judge Dana Fortinberry is adjourned from Aug. 8 until Nov. 28.
According to Examiner Paul Fischer of the Michigan Judicial Tenure Commission, the attorney for Judge Fortinberry was called to jury duty for the week originally set in August. Several scheduling conflicts between the involved parties during rescheduling attempts resulted in the November 28 date, said Fischer.
With witness lists exchanged, the parties involved are now simply waiting for the hearing to start said Fischer.
The Honorable Robert A. Benson (retired) will serve as master of the hearing and make a recommendation to the Michigan Judicial Tenure Commission.
As stated on the commission’s Web site, after the public hearing, the Michigan Judicial Tenure Commission will review the matter and, if warranted, make a recommendation to the Michigan Supreme Court regarding possible sanctions against Judge Fortinberry. The Supreme Court may then impose a sanction against Judge Fortinberry using that recommendation.
