Medical examiner rules Gailey’s death a homicide

Oxford resident Daryne Gailey’s death has been ruled a homicide by the Oakland County Medical Examiner’s Office.
Incised wounds (sharp, cut-line injuries) to the neck were determined to be the cause of death.
Gailey, a 2003 Oxford High School graduate and full-time clerk at the Kroger grocery store in Lake Orion, and his 7-month-old daughter, Charley Lillian Hendrick, were found dead on Sunday, Nov. 23 in his home at 148 Kintyre, just west of M-24.
Hendrick’s death was the result of blunt force trauma to the head and had been previously ruled a homicide. Her body was found laying in her crib in her bedroom.
Gailey’s body was found in the bathroom. He had three superficial cuts to his throat and one deep laceration, according to the Oakland County Sheriff’s Office.
Among the evidence collected at the scene was a boxcutter.
Deputies found Sylvia Majewska, Gailey’s mother, alive and sitting in the Kintyre home’s living room with multiple cuts on her wrist and arm, which was soaking in a bucket of water. She was conscious and able to speak, but was described as incoherent.
The 65-year-old Addison resident has been hospitalized in Pontiac since the incident.
When asked to comment on the Medical Examiner’s Office ruling, Oakland County Undersheriff Mike McCabe said, ‘The case is still under investigation. (Majewska) is still hospitalized and we have still been unable to talk to her. The bottom-line is we’re not going to have any further comment until Monday.?
Majewska had guardianship over Gailey because he was developmentally disabled and had a mental age of around 14 to 16 years old.
Gailey was not allowed to be alone with his daughter.
According to a divorce judgment dated Nov. 3, 2014, Gailey was granted parenting time every other week, but it had to be supervised by Majewska or ‘another competent adult of (her) choosing.?
Hendrick’s mother, Amanda Hendrick Gailey, lives in Tuscola County. She was awaiting her daughter’s return on the night of Nov. 22. When Gailey didn’t show up with her, local authorities were contacted.
