Demo back in play

The Clarkston Historic District Commission (HDC) will meet on Sept. 10 to reconsider a request from property owners to demolish the house and outbuildings at 42 W. Washington.
The city attorney appeared before the Administrative Law court in Lansing on Aug. 7 about the matter. The judge remanded the case back to the HDC.
The owners, Lehman Investment Company of Clarkston, first made the request in August 2017.
HDC voted to deny the request in October 2017, and Lehman appealed. Michigan Administrative Judge Petter L. Plummer wrote an opinion in June 2018 in favor of the property owners, recommending the State Historic Preservation Office (SHPO) set aside the HDC decision.
The city filed exceptions to the recommendation with SHPO, which scheduled the matter for its September 2018 meeting and rescheduled it for January 2019. The Administrative Law Judge assigned by SHPO directed the HDC reconsider the request.
