TO THE RESIDENTS AND PROPERTY OWNERS OF THE CHARTER TOWNSHIP OF INDEPENDENCE, OAKLAND COUNTY, MICHIGAN, AND ANY OTHER INTERESTED PERSONS:
PLEASE TAKE NOTICE, that at a regular meeting of the Charter Township of Independence Board of Trustees held on October 18, 2022, the Township Board approved a First Reading of the Zoning Ordinance Chapter 50, Article 11, Section 11.08 relating to Lake Access Regulations, as presented. The Board authorized a Second Reading pending the completion of the required notice publication.

ORDINANCE AMENDING ZONING ORDINANCE
(Text Amendments to Zoning Ordinance)
AN ORDINANCE TO AMEND THE INDEPENDENCE CHARTER TOWNSHIP CODE OF ORDINANCES, CHAPTER 50, “ZONING ORDINANCE,” BY AMENDING ARTICLE 11, “ENVIRONMENTAL STANDARDS,” SECTION 11.08, “LAKE ACCESS REGULATIONS” FOR PURPOSES OF PROHIBITING MULTI-FAMILY USE OF AN OCCUPIED RIPARIAN PROPERTY AND TO REGULATE BOAT DOCKING OR MOORING FOR THE BENEFIT OF ONE OR MORE OWNERS OR OCCUPANTS OF BACK LOTS AS A SPECIAL LAND USE.
Section 1. ORDINANCE AMENDMENT.
Chapter 50, “Zoning Ordinance,” Article 11.08, Section 11.08, “Lake Access Regulations,” Subsection (A) through (E) of the Charter Township of Independence Code of Ordinances shall read as follows:
A. General Purpose and Intent. The overarching purpose and intent of the Township is to promote harmony on watercourses, protect natural resources, stabilize property values, and generally protect the public health, safety, and welfare. This section seeks in particular to prevent the harms that arise when riparian properties are used as boat docking and mooring sites for back lot owners.
