Public Notice: Independence Township Code of Ordinances update

NOTICE IS HEREBY GIVEN that at its regular meeting on May 9, 2023, at the Township Hall located at 6483 Waldon Center Drive, Clarkston, Michigan 48346 Township, Michigan, the Charter Township of Independence Board of Trustees approved the second reading and adoption of Amendments to the Township’s Code of Ordinances.

A true copy of the Ordinance is on file and available for viewing between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday at the Independence Township’s Clerk’s Office, 6483 Waldon Center Drive, Clarkston, Michigan 48346 and available on the Township’s website at www.indtwp.com.

ORDINANCE DETERMING PUBLIC PURPOSE AND APPROVING DOWNTOWN DEVELOPMENT AUTHORITY DEVELOPMENT PLAN AND TAX INCREMENT FINANCING PLAN

AN ORDINANCE TO AMEND THE CHARTER TOWNSHIP OF INDEPENDENCE CODE OF ORDINANCES TO ADD CHAPTER 11, ARTICLE III, DIVISION 2, FOR THE PURPOSE OF DETERMINING THAT THE DOWNTOWN DEVELOPMENT AUTHORITY DEVELOPMENT PLAN AND TAX INCREMENT FINANCING PLAN CONSTITUES AND SEEKS TO ACCOMPLISH A PUBLIC PURPOSE AND ADOPTING SAID PLANS.

Section 1 of Ordinance.
Determination of public purpose.
Following a duly noticed public hearing on the development plan and tax increment financing plan for the Downtown Development Authority (herein referred to as “the plan”), and having made the findings set forth below, the Township Board has found and determined that the plan constitutes and seeks to accomplish a public purpose, and that the plan is consistent with and seeks to accomplish the intent and purpose declared by this board for the establishment of the Downtown Development Authority in Ordinance 2023-11-001:
1. The tax increment financing plan meets the requirements of MCL 125.4214;
2. The development plan meets the requirements of MCL 125.4217(2);
3. The proposed method of financing is feasible and the authority has the ability to arrange the financing;
4. The development is reasonable and necessary to carry out the purposes of Act 57 of 2018;
5. The land included within the development area to be acquired is reasonably necessary to carry out the purposes of the plan and of Act 57 of 2018 in an efficient and economically satisfactory manner;
6. The plan is in reasonable accord with the master plan of the Township;
7. Public services, such as fire and police protection and utilities, are or will be adequate to service the project area; and
8. Changes in zoning, streets, street levels, intersections, and utilities are reasonably necessary for the project and for the Township.

Section 2 of Ordinance.

Premised upon the findings and determinations made in section 1, above, and upon the further finding that pursuit and execution of the plan appears to be in the best interest of the Township, the plan, dated May 9, 2023, is hereby approved and adopted, subject to any Tax Sharing Agreement allowed by law and approved by Independence Township, the Independence Downtown Development Authority and any assessed Taxing Jurisdiction as identified in the Plan.
No amendment of the plan shall be effective unless and until submitted to and approved by the township board in accordance with the procedures set forth in Act 57 of 2018.
Section 3 of Ordinance.

Enactment. This Ordinance is declared to have been enacted by the Township Board of the Charter Township of Independence at a meeting called and held on May 9, 2023 and ordered to be given publication in the manner prescribed by law.
