Kyle Burch, 19 of Lake Orion and David VanLuven, 18 of Davisburg, were lodged in Oakland County Jail and charged with one count each for attempted breaking and entering and possession of burglary tools after they allegedly broke into a building on Wednesday, Nov. 10.
At approximately 1:25 a.m., Oakland County deputies from the Oxford substation responded to a breaking and entering alarm sounding at Oakwood Market, at the corner of Oakwood and Baldwin roads.
The responding officers approached the rear of the store and observed the two male subjects standing in an unlit area.
When officers ordered both subjects to the ground, one subject complied. The second subject fled on foot directly into the path of another officer’s patrol vehicle.
The officer narrowly missed colliding with the second male subject, who continued to flee the scene on foot. He was later taken into custody without further incident after police set up a perimeter.
A third suspect, Amy Leiman, 17 from Hadley Township, was also charged with one count of attempted B&E and possession of burglary tools because of her alleged involvement in the attempted heist.
She allegedly helped plan the heist and provided the tools and vehicle used.
Both Burch and VanLuven were arraigned on Nov. 11 in front of Magistrate Melinda Balian at the 52-3 court in Rochester Hills.
Balian set a bond for Burch at $10,000 cash, while VanLuven’s bond was set at $5,000 cash.
Leiman was arraigned on Nov. 12 in front of Magistrate Nicolas Camargo.
Her personal bond was set at $10,000, along with a 10 p.m. curfew and ordered not to have any contact with the victims or other defendants.
Both VanLuven and the Leiman have no criminal history. Burch’s criminal history includes convictions as an adult for B&E in 2008, possession of marijuana in 2009 and malicious use of a telecommunications device in 2010. He is on probation for marijuana possession in Romeo.
All three are scheduled for a pre-exam hearing in front of Judge Nancy Carniak on Tuesday, Nov. 23 at the 52-3 District Court.
