Public Notice: Clarkston zoning ordinance amendments re: short-term rentals

THE VILLAGE OF CLARKSTON
OAKLAND COUNTY, MICHIGAN
AN ORDINANCE AMENDING THE CODIFIED VILLAGE OF CLARKSTON ZONING ORDINANCE TO Amend Article 2, definitions, to add the definition of short-term rental, article 11, Village COMMERCIAL District, to add short-term as a permitted use, and amend article 14, General provisions and EXCEPTIONS, to add use provisions to regulate short-term rental uses.
The City Council of the Village of Clarkston hereby ordains:
SECTION 1. ADOPTION OF AMENDMENT TO OFFICIAL ZONING ORDINANCE.
Whereas, a proposed text amendment to Article 2, Article 11, and Article 14, to define short-term rental, add short-term rental as a permitted use in the Village Commercial Zoning District, and add short-term rental use provisions, was initiated by the Village; and
Whereas, this amendment has been reviewed by the City Planning Commission and recommends approval to the City Council; and,
Whereas, the proposed zoning classification amendment has been duly advertised and presented at a public hearing held by the City Planning Commission pursuant to requirements of Public Act 110 of 2006 as amended; and
Be it therefore ordained that: the City Council of Clarkston does hereby adopt the amendment to Article 2, Definitions, Article 11, Village Commercial District, and Article 14, General Provisions and Exceptions.
Be it further ordained that: this amendment shall be made to the Official Village Zoning Ordinance.
SECTION 2. AVAILABILITY.
The Official Zoning Ordinance is available for inspection at the City Hall. Supporting documentation for the Zoning Ordinance is available in the Office of the City Clerk at the City Hall. Copies of the Zoning Ordinance text, as amended, are available City Hall. The Village of Clarkston City Hall is located at 375 Depot Rd, Clarkston, MI 48346. Normal business hours are 8:00 am to 5:00 pm Monday through Friday.
SECTION 3. INCONSISTENCIES REPEALED.
Any and all other ordinances or resolutions or parts thereof in conflict herewith are hereby repealed.
SECTION 4. SEVERABILITY.
Should any section, clause or paragraph of this Ordinance be declared by court of competent jurisdiction to be invalid, the same will not affect the validity of the ordinance as a whole or part hereof other than the part declared to be invalid.
SECTION 5. SAVING CLAUSE.
That nothing in this Ordinance shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Ordinance.
SECTION 6. EFFECTIVE DATE.
The provisions of this zoning amendment are hereby ordered to take effect seven (7) days following its publication in a newspaper of general circulation within the City. This Ordinance is hereby declared to have been adopted by the City Council of the City of Clarkston in a meeting duly called and held on 10th day of January 2022.
