Public Notice: Independence Township, approval of amendments to Township Code of Ordinances

NOTICE IS HEREBY GIVEN that at its regular meeting on August 23, 2022, at the Township Hall located at 6483 Waldon Center Drive, Clarkston, Michigan 48346, the Charter Township of Independence Board of Trustees approved the Second Reading and Adoption of Amendments to the Township Code of Ordinances, Chapter 6, Article II, Sections 6-19 through 6-21.
A true copy of the proposed Ordinance is on file and available for viewing between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday at the Independence Township’s Clerk’s Office, 6483 Waldon Center Drive, Clarkston, Michigan 48346.

ORDINANCE AMENDING CODE OF ORDINANCES
(Text Amendments to Code of Ordinance)

AN ORDINANCE TO AMEND THE INDEPENDENCE CHARTER TOWNSHIP CODE OF ORDINANCES, CHAPTER 6, “AMUSEMENTS AND ENTERTAINMENTS,” BY AMENDING ARTICLE II, “SPEED EXHIBITIONS” FOR PURPOSES OF ADDRESSING HOURS AND DAYS OF OPERATION FOR QUARTER MIDGET RACING EXHIBITIONS.

THE CHARTER TOWNSHIP OF INDEPENDENCE ORDAINS:

SECTION 1. ORDINANCE AMENDMENT.
Chapter 6, Amusements and Entertainments,” Article II, “Speed Exhibitions” “Sections 6-19, “definitions;” 6-21(a)(5), “Hours of Operation;” and 6-20(b)(3), “Days of Operation;” and 6-21 “Quarter Midget Racing Exhibitions”, of the Charter Township of Independence Code of Ordinances is hereby amended to read as follows:

sec. 6-19 DEFINITIONS
L-1 means the statistical noise level standard which permits the stated maximum noise level to be exceeded one percent (1%) of the time during the measurement period;

SEC. 6-20(a)(5) HOURS OF OPERATION
Hours of operation for quarter midget racing tracks shall be governed exclusively by section 6-21 of this ordinance.

SEC. 6-20(b)(3) DAYS OF OPERATON
Days of operation for quarter midget racing tracks shall be governed exclusively by section 6-21 of this ordinance.
SEC. 6-21 QUARTER MIDGET RACING EXHIBITIONS.
Quarter midget racing exhibitions involve cars that are approximately one-quarter (1/4) the size of a full-size midget car and are sanctioned by the United States Auto Club, AAA, or any similar organization. Quarter midget racing exhibitions are “speed exhibitions” as that term is defined by this Ordinance and are subject to all regulations set forth under this Ordinance, with the exception of Sec. 6-20 above. Quarter midget racing exhibitions are generally distinguishable from other speed exhibitions in that the smaller cars emit lower noise levels that full size vehicles. Therefore, Quarter Midget Racing Exhibitions shall be allowed increased hours and days of operation in excess of those allowed for other Speed Exhibitions (see sec. 6-20) as set forth in this Section.

(a) Hours of operation. The licensee shall not permit the licensed premises to be utilized for or in connection with quarter midget racing exhibition purposes at any time other than the following:
(1)  On dates that quarter midget racing exhibitions are held as set forth in this section, spectators shall be permitted to enter and remain on the premises only between the hours of 8:00 a.m. and 10:00 p.m.

(2)  Quarter midget racing exhibitions shall be permitted between the hours of 8:00 a.m. and civil twilight. For purposes of this Ordinance “Civil Twilight” shall mean the period after sunset ending or beginning when the sun is about six degrees below the horizon and during which on clear days there is enough light for ordinary outdoor occupations.

(3) On dates that quarter midget racing exhibitions are held as set forth in this section, the use of a public announcement system (“PA” system) shall be limited to the hours of 10 a.m. and 6 p.m.

(b)   Days of operation. A speed exhibition shall be conducted on and weekday or weekend day beginning on April 1 and ending on October 31 of the calendar year.

SECTION 2. ENACTMENT.
This Ordinance will be enacted by the Township Board of Trustees of the Charter Township following a second reading and upon publication in the manner prescribed by law.
