Public Notice: Clarkston Mill Ponds Lake Improvement Board, hearing of practicability and assessment, Feb. 28, 2023

NOTICE OF HEARING OF PRACTICABILITY AND ASSESSMENT
CLARKSTON MILL PONDS LAKE IMPROVEMENT BOARD
TAKE NOTICE that the Clarkston Mill Ponds Lake Improvement Board will hold a public hearing on the practicability of approving a 2023 budget amendment to include the addition of a line item in the not-to-exceed amount of $5,600 to fund a portion of the match required for a Dam Risk Reduction grant from the Michigan Department of Environment, Great Lakes and Energy (EGLE). The purpose of the grant is to provide financial assistance to complete a legal lake level study for the Clarkston Mill Ponds and engineering for a new dam. The required match funds will be approximately $10,600, of which $5,600 will come from the Lake Improvement Board surplus funds. The hearing will be held at the Independence Township Hall, 6483 Waldon Center Drive, Clarkston, Michigan on Tuesday, February 28, 2023 at 6:00 p.m.
NOTICE IS FURTHER GIVEN that the Clarkston Mill Ponds Lake Improvement Board will hold a hearing of assessment immediately following the aforementioned hearing of practicability for the purpose of approving the use of surplus special assessment funds collected to pay for the Grant match and hearing any objections thereto. An owner of or party with interest in real property to be assessed, or his or her agent, may appear in person to protest the special assessment and be heard at the Hearing of Assessment. The protest must be submitted formally in writing to the Lake Improvement Board at the Hearing or prior to the date of the Hearing by mail to: Clarkston Mill Ponds Lake Improvement Board c/o Ms. Jacy Garrison, Oakland County Water Resources Commissioner’s Office, One Public Works Drive, Bldg 95W, Waterford, Michigan 48328-1907 or by email to: garrisonj@oakgov.com. Notice is also given that the owner of any real property within the Clarkston Mill Ponds Special Assessment District who, having made an objection to said use of special assessment funds either in person or in writing, may, within thirty (30) days after the confirmation of the special assessment roll, appeal such special assessment to the Michigan Tax Tribunal or other court of competent jurisdiction.
