NOTICE OF PUBLIC HEARING ON
THENDARA – DISTRICT 2
PRIVATE ROAD WINTER MAINTENANCE AND REPAIRS
AMENDMENT TO THE SPECIAL ASSESSMENT ROLL

TO THE RESIDENTS AND PROPERTY OWNERS OF THE CHARTER TOWNSHIP OF INDEPENDENCE, OAKLAND COUNTY, MICHIGAN, AND ANY OTHER INTERESTED PERSONS:

PLEASE TAKE NOTICE that the Supervisor and Assessing Officer of the Township have reported to the Township Board and filed in the office of the Township Clerk for public examination, a proposed amended special assessment roll covering all qualifying properties within the Special Assessment District known as Thendara – District 2 Private Road Winter Maintenance and Repairs, benefited by the winter road maintenance and repairs within the Thendara – District 2 Private Road Winter Maintenance and Repairs. Said assessment roll has been prepared for the purpose of assessing the costs for the aforesaid Special Assessment District consistent with the contracts for work on file with the Township Clerk at 6483 Waldon Center Dr., Clarkston, MI 48346,

TAKE FURTHER NOTICE that the Independence Township Board of Trustees will hold a public hearing on October 4, 2022, at 6:00 pm in the Township offices at 6483 Waldon Center Dr., Clarkston, MI 48346, to hear and consider any objections to the proposed amendment to the amended Special Assessment Roll. Said roll, may be examined at the office of the Township Clerk during regular business hours, of regular business days, until the time of said hearing and may further be examined at said hearing. A recorded statement of protest at the hearing is required in order to appeal the amount of the special assessment to the State Tax Tribunal.

Periodic redeterminations of the costs of the Public Improvements may be necessary, without a change in the Special Assessment District, and in that event, such redeterminations may be made by the Township Board without further notice to record owners or parties in interest in the lands in the Special Assessment District, in accordance with the provisions of said Act 188 (unless the amounts assessed increase by more than ten (10%) percent from the prior year, in which case notice and public hearing will occur). Property shall not be added to the proposed Special Assessment District, and the original estimate of costs shall not be increased by more than ten (10%) percent per year without further notice and public hearing. The contracts for the work to be performed for the proposed SAD are on file with the Township Clerk for public examination at the Township Offices during regular Township business hours. Any delinquent assessments within the Special Assessment District may be reviewed annually by the Township, and pursuant to Act 188, the Township Board may levy pro rata additional assessments in the Special Assessment District to make up any deficiency from such delinquent special assessments. Annual determination of the cost of the scope of the improvement may be made and that a public hearing will not be necessary for such annual redeterminations, provided the annual cost does not exceed the estimate by ten (10%) percent in accordance with PA 188 of 1954.

An owner, or party in interest, or his or her agent may appear in person at the hearing to protest the special assessment or shall be permitted to file his or her appearance or protest by letter, and his or her personal appearance shall not be required. Protests by letter should be filed with the Township Clerk, Cari Neubeck at cneubeck@indtwp.com prior to the date of the public hearing. The owner or any person having an interest in the real property who protests in person or in writing at the hearing may file a written appeal of the special assessment with the state tax tribunal within thirty (30) days after the confirmation of the Special Assessment Roll.

Independence Township will provide necessary, reasonable auxiliary aids and services, such as signers for the hearing impaired and audio tapes of printed material being considered at the hearing, to individuals with disabilities at the hearing upon adequate prior notice to the Township Clerk. Individuals with disabilities requiring auxiliary aids or services should contact the Township at the address or phone number listed.
